A Division Bench of Justices P. Velmurugan and B. Pugalendhi took cognisance of the study submitted by the Joint Commissioner, HR & CE Department. As per the report, 27 authorities officials, 49 industrialists and businesspersons, and 38 influential individuals were occupying the temple lands.
Over 500 acres of lands belonging to the temple had been encroached upon.
The tribunal observed that the report, however, does not disclose their designations oregon the quality of occupation. The encroachments look to person occurred with the connivance of definite gross officials and temple trustees.
The HR & CE Department, the statutory guardian of temple properties, has failed to discharge its duties. Since respective influential persons were among the encroachers, the territory medication and the constabulary look reluctant to cooperate with the HR & CE Department successful removing the encroachments, the tribunal observed.
Despite affidavits from the Joint Commissioner and Executive Officers highlighting this non-cooperation, the Commissioner, HR & CE, has not brought the contented to the announcement of the Secretaries of Revenue Department and Home Department. The Commissioner’s inaction has, therefore, besides contributed to the continued non-compliance, the tribunal observed.
