Tamil Nadu government cannot restrict maternity leave to just 12 weeks for third pregnancy: Madras High Court

The Madras High Court has disapproved of a Tamil Nadu authorities determination to restrict the maternity permission to conscionable 12 weeks for the 3rd gestation of women authorities servants who are different entitled to 365 days of permission for the 2 pregnancies.

Second Division Bench of Justices R. Suresh Kumar and N. Senthil Kumar said, determination was “absolutely nary justification” for the State authorities to person issued a Government Order (G.O.) connected March 13, 2026 restricting the maternity permission for the 3rd gestation to conscionable 3 months.
