Supreme Court quashes copyright case against filmmaker Sujoy Ghosh over his 'Kahaani 2' film

The Supreme Court connected Friday (March 20, 2026) quashed the proceedings pending earlier a Jharkhand tribunal against filmmaker Sujoy Ghosh successful an alleged copyright infringement lawsuit implicit his movie Kahaani 2.

A seat of Justices P.S. Narasimha and Alok Aradhe allowed Ghosh's plea, challenging a Jharkhand High Court's bid (dated April 22, 2017), which had refused to quash the proceedings pending against him.

"The summoning bid dated June 7, 2018 passed by the CJM (Chief Judicial Magistrate) and bid dated April 22, 2025 passed by the precocious tribunal are quashed and acceptable aside," the seat said, portion allowing Ghosh's plea.

In July past year, the apical tribunal issued announcement to the Jharkhand authorities connected Ghosh's plea to quash the lawsuit pending earlier the tribunal of CJM, Hazaribagh.

The filmmaker had moved the High Court against the CJM court's bid holding a prima facie lawsuit of copyright infringement against him nether Section 63 of the Copyright Act, 1957.

The High Court dismissed Ghosh's plea, observing it would not behaviour a "mini-trial" astatine the quashing stage, and the issues could beryllium tested during trial.

The complainant, Umesh Prasad Mehta, had written a publication for the movie Sabak which was certified by the Notary Public of Hazaribagh for obtaining its copyright.

It was alleged that the complainant met Ghosh and obtained a proposal letter, which was indispensable for obtaining the copyright of a movie script.

Ghosh allegedly kept a photocopy of the publication of the complainant and knowingly infringed the copyright of the complainant by producing a movie Kahaani 2.

The movie was watched by the complainant successful a movie hub astatine Hazaribagh.

After watching the film, the complainant alleged that Ghosh violated his copyright by committing theft of his publication and infringed its copyright.
