Kerala HC confirms conviction of madrassa teacher in POCSO case

The Kerala High Court affirmed the bid passed by the Fast Track Special Court (POCSO), Kunnamkulam, convicting a madrassa teacher for sexually assaulting his student.

The accused was charged nether the Indian Penal Code and the Protection of Children from Sexual Offences (POCSO) Act, 2012, and the Juvenile Justice (Care and Protection of Children) Act, 2015, for sexually assaulting a 9-year-old pupil who had visited him astatine his residence to wide doubts regarding an online introspection astatine the madrassa during the COVID-19 period.

The Special Court had recovered him blameworthy of each charges and had sentenced him to 20 years of imprisonment. The accused moved the High Court against this order, claiming that mendacious charges were laid against him by persons of different sect successful the Muslim community. 

The authoritative contended that determination was nary grounds to enactment the statement of the accused and, much importantly, determination were nary worldly contradictions successful the grounds fixed by the survivor. 

No contradiction

A Bench of Justice A. Badharudeen considered the question of guilt nether the offences charged against the accused and the Special Court’s order. The tribunal held that determination was nary contradiction to beryllium recovered successful the survivor’s statement; it was ‘wholly reliable’ and supported by different grounds fixed earlier the court. 

Further, the tribunal rejected the assertion that sectarianism successful the Muslim assemblage led to the charges against the accused, reasoning that determination was nary convincing grounds to backmost up the argument. 

The court, successful conclusion, stated that the bid of the Special Court needed nary interference and confirmed the condemnation made by it.
