IRCTC ‘scam’ case: Delhi HC to hear Lalu Prasad’s petition against framing charges on Jan. 5

Besides Mr. Lalu Yadav, the Court had framed charges against Pradeep Kumar Goel, Rakesh Saksena, Bhupendra Kumar Agarwal, Rakesh Kumar Gogia and Vinod Kumar Asthana nether Section 13(2) work with Section 13(1)(d)(ii) and (iii) of the Prevention of Corruption (PC) Act.

Section 13 (2) deals with the punishment for transgression misconduct by a nationalist servant, and Section 13(1)(d)(ii) and (iii) with maltreatment of presumption by a nationalist servant to get favours.

The Court had besides directed that the complaint beryllium framed nether IPC Section 420 (cheating) against Lalu Prasad, Rabri Devi, Tejashwi, M/s LARA Projects LLP, Vijay Kochhar, Vinay Kochhar, Sarla Gupta, and Prem Chand Gupta.

"A communal complaint is directed to beryllium framed against each (14) accused nether conception 120B (criminal conspiracy) IPC work with conception 420 IPC and conception 13(2) work with conception 13(1)(d)(ii) and (iii) PC Act," the tribunal had said.

The maximum punishment nether the PC Act is 10 years, portion for cheating is 7 years.
