The Madurai Bench of the Madras High Court has upheld the beingness condemnation awarded by a proceedings tribunal successful Virudhunagar territory to a pastor for sexually assaulting a miss with carnal and intelligence disability.

The lawsuit of the prosecution is that successful 2022 the pastor sexually assaulted the miss who was said to beryllium 70% disabled with mean intelligence disablement and code impairment. The proceedings tribunal recovered the appellant blameworthy of the offences nether Section 5(f) and 5(k) work with Section 6 of the POCSO Act on with Section 92(d) of the Rights of Persons with Disabilities Act, 2016 and sentenced him to acquisition imprisonment for beingness and besides imposed a good of ₹1 lakh.
A Division Bench of Justices G.K. Ilanthiraiyan and R. Poornima held the proceedings tribunal had correctly applied Section 42 of POCSO Act and rightly awarded the higher punishment prescribed nether Section 6 of the Act considering that the offence nether Section 92 of the Rights of Persons with Disabilities Act, 2016 besides prescribes a minimum punishment.
“The tribunal finds nary perversity, illegality, oregon mis-appreciation of grounds warranting interference with the well-reasoned judgement of conviction. The prosecution grounds is recovered to beryllium reliable, cogent, and trustworthy. The proceedings court’s appreciation of grounds is successful consonance with the statutory strategy of POCSO Act and the principles governing intersexual offence cases,” the seat said.
“The tribunal finds nary merit successful the appeal. The condemnation of the appellant for offences nether Section 6 of the POCSO Act is sustained. The condemnation imposed by the proceedings tribunal is due and proportionate to the gravity of the offence,” the judges said.
