The Delhi High Court connected Wednesday refused to entertain a plea seeking the assignment of members of number communities different than Muslims and Sikhs arsenic chairperson of the National Commission for Minorities (NCM).
The petition claimed that the chairperson of NCM has been appointed from 2 number communities –Muslims and Sikhs – since the committee was established successful 1978. Of the 16 chairpersons appointed truthful far, 14 were Muslims and 2 Sikhs.
It added that members of different number communities, specified arsenic Christians, Buddhists, Zoroastrians, and Jains, person not been represented arsenic chairperson.
A Bench of Chief Justice D.K. Upadhyay and Justice Tushar Rao Gedela said the petitioner, Salek Chand Jain, could attack the authorities with his plea.
The tribunal observed that the National Commission for Minorities Act mandates the inclusion of members from number communities successful the commission, but does not necessitate the assignment of a chairperson from immoderate circumstantial community.
“Section 3 of the enactment lone provided that the committee shall dwell of a chairperson, vice chairperson, and 5 members. The enactment does not supply that the committee shall comprise each the members belonging to number communities,” the tribunal said.
“The lone proviso is that 5 members, including the chairperson, shall beryllium among the number communities. The proviso does not supply that the members oregon the chairperson shall beryllium from a peculiar number community,” it added.
The petitioner said helium submitted respective applications for the information of a chairperson from the Jain number community, but “no fruitful effect came guardant successful the past 2 years”.
